According to a report of the Auditor General of the City of Buenos Aires (AGCBA), the State has one lawyer and a non-professional to attend the trials arising from control of the delivery of public services assistant.

It is that staffing is integrating by the Department of Contentious Legal Affairs Single Regulator area of Buenos Aires Utilities (EURSP).

The report of the AGCBA, approved in 2010 on 2009 data, indicates that these two agents, the head of the Department and assistant "assume all tasks, including legal strategy, legal arguments, attendance at hearings, etc.". The auditors point out that "the small number of affected staff Legal Counsel", causes the staff to assume multiple tasks, adding that "this function overload results in a weak control environment". However, it also indicated that the agency itself reported that during 2010, two professionals working in another department of the Legal Counsel went on to serve in the Department of Contentious Affairs.

Also on the equipment of the EURSP, the watchdog said that computers are old, essentially cannot update software, and are insufficient; "Basis of one computer for every two line agents, in an area where the use of this tool is intensive." In addition, there is no specific software "judicial management tracking" or "use a service through Internet law". The Entity does not provide the area agents training in the use of computer tools "affecting the efficiency and effectiveness of the area."

Court Cases

Of the 146 judicial cases reported by the EURSP at the time of the audit, a sample of 46 files was taken. Of these, about "40% of internal folders do not have the elements or the necessary order to facilitate management." The auditors noted that the documents in the file are not in chronological order according to the sequence of events in the trial. They also verified that the documentation was not always sufficient or timely, which could become an obstacle to the reconstruction of the record.

In addition, four of the 46 cases sampled, the audit found that the EURSP was able to initiate judicial enforcement of fines imposed for failure to provide services, but nevertheless, "these executions were not initiated ".

In spite of these data, the AGCBA notes that "the audited management was efficient, despite the lack of resources" and stressed the importance of EURSP in monitoring the performance of public services to the City of Buenos Aires.

Finally, the agency said the main obstacle to improving the performance of the area was the difficulties of budget availability. In fact, the amount allocated for the budget year 2009 was approximately $33 million, remaining "unchanged from 2008".
