In Ezeiza and Marcos Paz 85% And 76% of Prisoners Are Prosecuted Without Firm Conviction
According to the AGN, it is because there are no centers dedicated exclusively to those who do not have a sentence. As reported by the Federal Penitentiary Service (SPF, for its acronym in Spanish) to the National Audit Office (AGN, for its acronym in Spanish), "57% of the detainees are being tried but not sentenced," while in the Federal Penitentiary Complex of Ezeiza and Marcos Paz, the non-condemned go to 85% and 76% respectively.
It is important to note that according to current legislation, establishments intended for defendants will not be able to accommodate convicts. However, "there are no centers dedicated exclusively to those who have no sentence."
The report also identified problems with SPF staff. The institution had for 2013 with $40 million for the payment of a Work Risk Insurer. However, that year, the more than 12,400 agents of the Prison Service "did not have insurance to protect them from the inherent risks of their work."
From January 2007 to October 2012 the service was provided by the Second ART, but "it is the same company that decided to terminate the contract for non-payment." In fact, "there is a lawsuit for $ 41.3 million for differences in quotas that, as of October 2014, the SPF had not responded."
In parallel, it was observed "a file for a direct contracting, classified as urgent, for a labor risk insurer." The process began in June 2012. By June 2014, "it was still in the Cabinet of Ministers, waiting for the signature." Meanwhile, in 2013 there were 454 accidents in the Service.
During the year under review, the SPF had 39 establishments in different jurisdictions that housed a total of 9795 inmates as of December 31st. According to the regulations in force, each center must have its own internal regulations that regulate issues such as income, outings, accommodation, food and hygiene.
However, "none of the 20 evaluated establishments had the approved Regulation." Only nine had "projects in process of approval." In addition, "there were no procedural manuals regulating the administrative functioning of each area."
In regard to the transfers, the team of auditors detected "inconsistencies" in the data. For example, "in January 2013 it was reported that the total number of inmates moved was 7462." However, "when we add the partial movements there were only 3813."
It was also observed that "there are no records of the transfers that could not be fulfilled in time and form or of the causes that originated that noncompliance."
Throughout 2013, 84,603 inmates were moved across the country. The aircraft that owns the SPF "is not suitable for this purpose and is used for maintenance flights." The aircraft "has no liability insurance for personal injury accidents."
On the other hand, of the vehicles destined to the transfer of inmates, "31% were out of service."
Health
Within this framework, we evaluated the central drugstore, located in Ezeiza, and the pharmacies that operate in prisons in the interior of the country. In this respect it is pointed out that most of them "are not qualified."
