A report of the Auditor General of the City of Buenos Aires (AGCBA) notes on the management of inspections and authorizations of the Directorate General of Inspection and Control (DGFyC), which was "adopted different criteria" to sanction various nightspots for the "same irregularities."

The distribution has primary responsibility to exercise police powers in relation to safety, health and hygiene on all types of (commercial, industrial, service, entertainment, etc.) establishments. However, according to the audit, "the staffing of the inspectorate is insufficient to develop an efficient exercise of that power, given the significant amount of premises it must supervise." The report says that in 2008 the agency only inspected "16.29% of the locations provided."

Meanwhile, although the Directorate "audited 100% (103) of night establishments registered in the National Register of Dance Clubs" during 2008- in "84 they verified irregularities" and "33 were closed" - the AGCBA explains that "in some cases it proceeded to become forceful, while in others, identical the preventive closure was carried out."

Thus, details the following examples: the "location Boyaca 28" was closed for "breach of Law 118", which regulates the provision of surveillance, custody and security, but in two other places facing the same irregularity only one report was drawn up.

The DGFyC closed an establishment because "it lacked the fire certificate" while facing the same flaw, it allowed the premises of "O'Brien” Santa Fe 1232 and 4999 to remain open. Preventively it closed the location Esmeralda 565 for “exceeding the capacity of people allowed" while, in the same case, proceeded to carve out a record in located in "Rafael Obligado 3731".

It also arises from the base inspections "a location had not complied with the summons to begin the process of empowerment, which led to its closure." Despite the first warning, the next inspection conducted by inspectors of the Directorate, was not fulfilled with the procedure against the injunction.

The report, approved this year on 2008 data, notes that in addition, "there are no regulations that define the criteria for selecting targets and whose frequency control is not provided", which "brings with it a wide margin of discretion" .

The AGCBA said that "changes on the structure of the distribution resulted in the dilution of responsibilities" and that "the lack of continuity of organizational history difficult to control."
 
On The Number of "Not Effective" Inspections 

According to the Audit of the City, "the total number of inspections (56,596) carried out during the reporting period, 14,994 had not been effective," meaning it could not be completed verification of the location because it was closed or the address was nonexistent.

On the audits made from complaints received in CGPC, the report says that of the 562 inspections, "242 belong to location addresses that are nonexistent or are closed." In 77% of cases reviewed, irregularities were found. Finally, as to educational establishments, where 64 schools were closed, "2,539 inspections, 611" could not materialize.

The Buenos Aires City Audit suggests that performing tasks that are not effective, is due to the "lack of coordination with the Directorate General Enabling and Permits as to update the standards".
